An individual who is unable to work for twelve (12) months or longer may qualify for Social Security disability, which is a claim for early retirement benefits due to a disability. The disability claimed can be the result of an on-the-job injury, a physical or emotional condition, or specific diseases.

If eligible, a disabled individual would receive monthly benefits from the Social Security Administration. These can include retroactive monetary benefits. Medical benefits through Medicare are only available two years after receipt of monetary benefits.

A disabled person has the right to retain an attorney in connection with a claim for Social Security disability benefits. The attorney only receives payment if successful. Payment is governed by the Social Security law, which provides for a fee of 25% of retroactive benefits up to a maximum currently of $6,000.
